TERMS & CONDITIONS
Registration on the Webstore:
Before placing your initial online order, you must register with The Grocery Express at www.online.groceryexpress.co.za. Click on Register to complete the registration form. By registering and using our online shopping services, you agree to adhere to and be bound by our Terms and Conditions. During registration, you will need to provide personal information, including payment card details (relevant to cash online customers), an email address, and a password. Ensure your personal information is secure, as we are not responsible for any damages or losses from unauthorised use. You will need to enter your email address and password each time you visit our Delivery Service at www.online.groceryexpress.co.za.
Product Sales and Availability:
All products listed on our webstore are subject to availability and will only be delivered within South Africa to the areas we service. Prices are quoted in South African Rands and are valid only in South Africa. We reserve the right to limit the number of units per customer and to change product specifications without notice. We will notify you if any ordered products or services are unavailable.
Delivery Charges:
A delivery charge of R 50 is levied on all orders less than R 1 000 per order. The management of The Grocery Express reserves the right to waive this charge in certain cases.
Content Errors:
We will not accept orders if there is a material error in the description or price of goods or services on our webstore. Packaging may differ from what is shown.
Pricing:
The price displayed on the webstore at the time of your order is the price you will pay, subject to availability. Prices for Home Deliveries (cash online customers) include VAT, while prices for Food Service Customers exclude VAT. Special promotions may have conditions, including stock availability and limited offers. For cash online customers a 15% charge will be added for variable weight products, and any difference between the online order and the final order value will be available for credit on your next order.
Alcohol Sales:
Alcohol purchases are subject to the Disaster Management Act 1957 and Covid-19 Lockdown Regulations, as amended, and each store's licence requirements. Alcohol may only be purchased by customers 18 years or older. In the Western Cape, the maximum amount of alcohol sold per customer per day is 150 litres, regardless of bottle size. This limit does not apply to other provinces.
Payment:
For cash online customers:
When placing an order, funds equal to the total order value will be reserved against your payment card during checkout. By submitting your order, identity number, and payment card details, you warrant that you are authorised to use the card and that sufficient funds are available. Payments may be made via VISA or Mastercard. We reserve the right to amend payment options from time to time.
For approved Cash on Delivery (“COD”) customers:
Payment can be made via Electronic Funds Transfer (“EFT”) or cash on delivery. For EFT payments, goods will only be released for delivery once the funds have cleared the bank account of The Grocery Express (Pty) Ltd. It is your responsibility as the client to ensure that payment is made into the correct account of The Grocery Express (Pty) Ltd.
For approved Account customers:
Payment must be made via EFT in accordance with the terms of the approved Credit Agreement in place. Goods will only be released for delivery once the funds have cleared the bank account of The Grocery Express (Pty) Ltd and the account is within terms and limit. It is your responsibility as the client to ensure that payment is made into the correct account of The Grocery Express (Pty) Ltd.
Stock Availability:
We cannot always guarantee stock availability and may deliver a substitute product if authorised by you. If we cannot supply certain items or quantities, you agree to accept delivery and pay for the items delivered.
Confirmation of Orders and Delivery:
Your order is accepted when you receive an order confirmation via email, however we reserve the right to cancel an order if a payment has not cleared or an account is out of terms or over the approved limit. On delivery, you will receive a delivery note showing a summary of the delivered items. A detailed tax invoice will be emailed to you, showing the products purchased, VAT, and the amount debited from your payment card (cash online customers) or added to your account (COD and account customers). You may be asked to log in to our webstore to check the items when the driver arrives. You or your authorised representative will be asked to sign a delivery note or on an electronic device to confirm receipt. The person accepting delivery may need to show a form of identification. If no one is available at the time of delivery, the driver will keep the products and leave a notice. We will try to contact you to arrange a new delivery or collection. A delivery fee may be charged if required at our discretion.
Returns & Refunds:
You are responsible to examine goods on receipt for any damages or short deliveries. Claims for shortages or damages must be noted and signed for on the delivery document. Claims have the following time limits depending on the product type:
- Frozen and seafood products: must be claimed the same day as the delivery.
- Dairy, perishable, and meat products: must be claimed within 24 hours of delivery.
- Ambient products: must be claimed within 5 days of delivery.
Returns will only be accepted, and refunds authorised for products if they are in their original, sellable condition and only if they are within the product’s expiry date. The Grocery Express (Pty) Ltd will not return any item if there is a health risk due to public health and food safety regulations. Refunds for account clients will be processed as a credit on the account. Refunds for cash online clients will be processed as a credit and will be available on the next purchase.
Cancellation:
Orders can only be cancelled a day before the delivery day. We may charge your payment card for delivery fees for late cancellations. If you cancel your payment or if your payment card becomes invalid, you remain liable for the full purchase price and related costs. We reserve the right to cancel any sale or registration in the event of a breach of any of the Terms and Conditions. The Grocery Express (Pty) Ltd reserves the right to charge an administration fee of up to 3.5%.
Risk and Ownership:
Risk in the products passes to you or your authorised representative on delivery. Ownership of the products remains with us until payment is received in full.
Extended Payment and Delivery Terms and Conditions:
The Grocery Express (PTY) Ltd t/a The Grocery Express is a business in the Foodservice industry delivering grocery items to both businesses (B2B) and homes (B2C). Delivery of goods is subject to availability and receipt of payment. Requests will be processed within 3 days, and delivery confirmed by electronic invoice. Export restrictions apply, and the offering on this webstore is available to South African clients only.
Customer Privacy Policy:
We take all reasonable steps to protect users' personal information, as defined in the Promotion of Access to Information Act 2 of 2000 (PAIA).
Card Acquiring and Security:
For cash online customers, card transactions will be required by The Grocery Express (PTY) Ltd t/a The Grocery Express via Peach Payments, an approved payment gateway for all South African Acquiring Banks. Peach Payments uses SSL3 encryption, and no card details are stored on the webstore. Users may visit www.peachpayments.com to view their security certificate and policy. Customer details are stored separately from card details entered on Peach Payment’s secure site. The merchant outlet country is South Africa, and the transaction currency is South African Rand (ZAR).
Responsibility:
The Grocery Express (PTY) Ltd t/a The Grocery Express takes responsibility for all aspects of the transaction, including the sale of goods and services, customer service, support, dispute resolution, and delivery of goods.
Country of Domicile:
This webstore is governed by South African laws, and The Grocery Express (PTY) Ltd t/a The Grocery Express chooses South Africa as its domicilium citandi et executandi for all purposes under this agreement.
Variation:
We may change this agreement or any part thereof at any time without notice.
